Right of Withdrawal for the Consumer

 

Purchasers, who are consumers, are entitled by applicability of the regulations for distance contracts to a right to revoke the contract on condition of the following instructions:

 

Purchaser may revoke the order within a revocation period of one month without further specification of reasons in written form (e.g. letter or e-mail) or by returning the goods. The revocation period does not start before the delivery and the reception of this instruction. Punctual dispatch suffices as compliance with the time limit. The revocation must be declared to:

In case of an effective revocation, any performance received by one party is to be returned to the respective other, as are benefits derived from such performance, e.g. interest. If Purchaser cannot return the goods received in whole or in part, or if Purchaser can only return the received goods in a deteriorated state, Purchaser must pay compensation for value insofar. There is no obligation to pay compensation for value if the sole cause of deterioration of the good(s) received was the inspection of the respective good(s), as would have been possible in a retail shop. For the rest, Purchaser can avoid paying compensation for value in respect of deterioration in the good(s) as a result of their/ its proper use, if Purchaser does not use the good(s) the way Purchaser uses Purchaser's own property and refrain from doing anything that would curtail the value of the good(s). If the value of the order does not exceed Forty Euros (EUR 40) and the good(s) delivered correspond to the good(s) Purchaser ordered, Purchaser must bear the costs of return. If Purchaser is an EU-resident and if the value of Purchaser's order exceeds Forty Euros (EUR 40) the costs of return will be borne by Aloha-Beachwear.com.Obligatory refunds of payments must be made within 30 days after sending the revocation or returning the goods.

 

Notice:

 

Purchaser's Right of Withdrawal shall expire prematurely if the contract has been completely fulfilled at the specific request of both parties before Purchaser has made use of his/her Right of Withdrawal.

Restitution proceedings and consequences for Consumers

 

Buyers, who are consumers, are entitled by applicability of the regulations for distance contracts to a right of return for purchased articles on condition of the following instructions:

 

1.The buyer can return the goods within one month without explanation. The fixed period begins with receipt of these instructions in written form (as a letter, fax or e-mail), but not before the buyer receives the goods (for recurring deliveries of similar items, not before the buyer receives the first partial delivery) and not before the completion of the duty to inform the buyer. The buyer can declare a return with a return request in written form when the goods are not transportable as a parcel, e.g. bulky goods. An on time dispatch of the goods or the return request complies with the two-week deadline. In either case, the return is done at the cost and risk of the seller. 2. In the case of effective return, the goods and services taken by either party are to be returned and if applicable, goods and services used (e.g. compensation for use) are to be compensated. A value compensation claim can be demanded with the deterioration of goods. This does not apply if the deterioration of the goods is exclusively attributed to testing, as it would be possible for buyers to do in shops. Otherwise the buyer can avoid the obligation for value replacement for using the goods according to the terms and conditions by not using the goods as his/her own property and omitting anything that impairs the value of the goods. The obligation to refund payments must be fulfilled within 30 days. The time limit begins for the buyer when the goods or return requisition are shipped; the time limit begins for the seller at the receipt of sent goods or the return requisition.
